A PIL has been filed in the Supreme Court seeking direction on the issue of admission and continuation of studies in the country of Indian medical students recently expelled from war-torn Ukraine. The plea has also sought a direction to the Center to provide a medical subject equivalence orientation program for admitting them to the Indian curriculum.
The petition, filed by advocate Rana Sandeep Busa and others, said that their writ petition seeks to enforce the foremost fundamental right guaranteed under Article 21—safety of life and personal liberty. Since the outbreak of war between Russia and Ukraine and the withdrawal of students from Ukraine, a number of petitions have been filed in the High Court and Supreme Court, urging the Center to direct that Indian medical students returned from Ukraine should be given domestic help. Facility should be given to continue studies in colleges.
‘Fundamental Right to Education is being denied’
An application has also been filed on behalf of the Pravasi Legal Cell before the Delhi High Court, requesting the Center to give directions in this regard. The petition filed in the top court said that the central government has done tremendous work in bringing back Indian students, but they are being denied the fundamental right to education. It states that the government will have to take steps to include foreign medical students in the Indian medical curriculum.
The petition said that since the National Medical Commission has allowed foreign medical graduates to complete their internship in India due to the ongoing war between Ukraine and Russia, the government should consider the plight of these medical students. .
