A strange case of divorce has come to the fore in the Supreme Court. In this case, the Supreme Court, while hearing the petition filed by the husband seeking divorce, has issued a notice to the wife in this regard. The husband has sought divorce on the ground of cheating. The husband says that his wife is not a female.

A bench of Justice Sanjay Kishan Kaul and Justice MM Sundaresh on Friday asked the wife to file a reply on the husband’s petition challenging the Gwalior Bench of Madhya Pradesh High Court’s order 29-07-2021. The Court said that “As per the counsel for the petitioner, the medical history of the respondent contains “Gender + Imperfect Hymen”. Therefore, the respondent is not a woman.

In the petition filed by the petitioner’s lawyer Praveen Swarup, it has been told that the marriage of the man and the woman took place in July 2016. After marriage, the wife did not have a relationship for a few days saying that she was going through menstruation. After this she left her husband’s house and went to her maternal home. After 6 days she returned to her in-laws’ house. After this, when the husband tried to have a relationship again, it was found that the private part of the wife was not like that of the female. Rather it was like a child’s private part. The husband then took her for a medical check-up, where it was discovered that she had a medical problem named ‘Imperfect Hymen’ (a medical condition in which the hymen covers the entire opening area of the vagina).
Felt cheated after medical checkup
After this the woman was advised surgery, but the doctor also said that an artificial vagina will be created by surgery, but the possibility of the woman becoming pregnant is almost impossible. After this, this person felt cheated and called the father-in-law and asked him to take his daughter back.

According to the petitioner, the woman was then taken away, but after a few days she returned to his home after undergoing an operation. Her father also pressurized her to keep her forcibly.
High Court’s decision was challenged
After this the victim went to the Madhya Pradesh High Court. Here the court dismissed the allegations of his deception on 29 July 2021. After this the victim reached the Supreme Court.
